Can I get my California DUI conviction expunged?

A DUI conviction can lead to multiple adverse life consequences. For instance, it could be more difficult to retain or find new employment. Depending on the circumstances, you can receive an expungement for a DUI conviction in California.

DUI expungement is the process of having your DUI conviction cleared from your criminal record. With a DUI expungement, you would no longer be required to disclose your DUI conviction to most employers or on job applications. In addition, your conviction would not show up on background checks. It is important to note that there are a couple of exceptions. If you are applying for a public position or a local or state license, then you must disclose your conviction.

Am I eligible for California DUI expungement?

There are many situations in which you could be eligible for DUI expungement in California. However, generally, you must meet these basic criteria:

  • You have completed probation for your DUI offense
  • You were not sentenced to state prison for your DUI offense
  • You are not on probation for a separate offense
  • You have not been charged with a separate offense
